REFUND AND CANCELLATION POLICY

The Kreativ Block supplies digital products and professional/productised digital services.

Nothing in this Policy excludes, restricts or limits a consumer right that cannot lawfully be excluded under applicable South African law.

DIGITAL PRODUCTS

Digital products are delivered electronically.

Once a digital product has been successfully delivered or download access has been provided, TKB does not ordinarily provide a change-of-mind refund to the extent permitted by law.

This does not affect any statutory right that may apply where a digital product is materially defective, materially misdescribed, incorrectly supplied or inaccessible because of a failure attributable to TKB.

Where a download does not function correctly, customers should contact TKB so that we can investigate the issue and, where appropriate, restore access or provide the correct file.

SERVICES

Customers wishing to cancel a service should notify TKB in writing as soon as possible.

Where work has not commenced, any cancellation and refund will be assessed in accordance with applicable statutory rights and any lawful costs or commitments already incurred.

Where work has commenced, TKB may charge for work reasonably completed and non-recoverable costs or commitments reasonably incurred, to the extent permitted by law.

Where a service materially fails to meet a standard or right imposed by applicable law, the remedies provided by that law remain available.

DEPOSIT PRODUCTS

A deposit forms part of the total agreed project fee and is credited toward that amount.

A deposit is not automatically forfeited merely because a customer cancels a project.

Where permitted by law, TKB may retain amounts reasonably attributable to work already performed, commitments already incurred or a reasonable lawful cancellation charge.

Any balance that is refundable will be calculated after those amounts have been taken into account.

EARLY COMMENCEMENT OF SERVICES

Where a customer expressly requests or agrees that TKB should begin providing an electronically purchased service before the expiry of an otherwise applicable statutory cooling-off period, performance may begin immediately.

Any resulting cancellation or cooling-off rights remain subject to the Electronic Communications and Transactions Act and other applicable South African law.

DUPLICATE OR INCORRECT PAYMENTS

A verified duplicate payment or amount charged in error will be corrected or refunded.

REFUND PROCESSING

Where a refund is approved, it will ordinarily be returned through the original payment method where reasonably possible.

The period required for the funds to appear in a customer's account after processing may depend on the relevant bank or payment provider.
