2. Purpose of this PAIA Manual

This Manual is prepared for The Kreativ Block (Pty) Ltd, a private body, in terms of section 51 of PAIA. It is intended to help members of the public understand what records TKB holds, which records may be available without a formal request, how to request access to a record, and how TKB processes personal information for purposes contemplated by PAIA and POPIA.

4. Guide on how to use PAIA and obtain access to the Guide

The Information Regulator has published a Guide on how to use PAIA. The Guide explains the objects of PAIA and POPIA, how to request access to records, applicable remedies and complaints, and the role of the Information Regulator.

5. Categories of records available without a formal PAIA request

Subject to authentication or lawful limitations where information is customer-specific, the following categories may be available without a formal Form 2 request:

  • business contact details, company registration information and public supplier disclosures;
  • Privacy Policy, Terms of Service, Refund and Cancellation Policy, Digital Delivery Policy and Legal Notice;
  • this PAIA Manual and public instructions for access requests;
  • public product and service descriptions and displayed prices;
  • published insights, articles and public marketing material; and
  • a customer's own order confirmations, receipts and service documentation, subject to appropriate identity verification.

Paid digital products, proprietary manuals, internal methodologies, confidential project records and third-party confidential information are not automatically available merely because TKB holds them.

6. Records available in accordance with other legislation

Depending on the nature of the record and TKB's activities, TKB may create, retain or make records available in accordance with the following South African legislation and related regulations, to the extent applicable:

  • Companies Act 71 of 2008;
  • Promotion of Access to Information Act 2 of 2000;
  • Protection of Personal Information Act 4 of 2013;
  • Electronic Communications and Transactions Act 25 of 2002;
  • Consumer Protection Act 68 of 2008;
  • Income Tax Act 58 of 1962 and Tax Administration Act 28 of 2011;
  • Basic Conditions of Employment Act 75 of 1997 and Labour Relations Act 66 of 1995, where applicable; and
  • Unemployment Insurance legislation and COIDA, where applicable.

The inclusion of legislation in this Manual does not mean every listed statute applies to every TKB activity or that every record is automatically accessible. Access remains subject to PAIA, POPIA and any lawful ground for refusal or confidentiality obligation.

7. Subjects on which TKB holds records and categories of records

  • Corporate governance: registration documents, governance records, resolutions, director records, policies and compliance records.
  • Finance and tax: invoices, receipts, bank/payment records, accounting records, budgets, tax submissions and supporting documents.
  • Customers and sales: customer contact details, enquiries, orders, invoices, payment status, contracts/scopes, onboarding information, support and correspondence.
  • Products and services: product listings, service specifications, digital-delivery records, manuals, templates and internal delivery documentation.
  • Marketing and website: website content, campaign records, public social content, lead forms, consent records and website analytics.
  • Projects and delivery: project briefs, working files, approvals, deliverables, implementation records and handover documents.
  • Suppliers and service providers: supplier details, contracts, invoices, service records and correspondence.
  • Technology and security: system configurations, access-control records, integration documentation, incident records, backups, logs and security procedures.
  • People and contractors: employment/contract records, remuneration, tax, leave, performance and identity records, where applicable.
  • PAIA and POPIA compliance: PAIA requests, privacy requests, Information Officer records, notices, assessments, incident records and compliance documentation.

8. Processing of personal information

8.1 Purposes of processing

TKB may process personal information for providing products and services; handling orders, payments, digital delivery, support, enquiries, audits and onboarding; performing project work; maintaining financial, tax and corporate records; securing and improving its website and systems; preventing fraud; complying with law; and marketing where a lawful basis or valid permission exists.

8.2 Categories of data subjects and information

  • Customers and prospective customers: names, contact details, business details, billing/transaction information, order history, website URLs, assessment responses, project information and correspondence.
  • Website users: technical usage, device/browser information, cookies/consent data and form submissions where collected.
  • Suppliers and service providers: names, business contact details, company/tax information where relevant, contracts, invoices and payment details.
  • Directors / office bearers: identity, contact and corporate/statutory information.
  • Employees / contractors, where applicable: identity, contact, employment, remuneration, tax, banking, qualification and performance information.

8.3 Recipients or categories of recipients

Personal information may be supplied, where necessary and lawful, to ecommerce and payment providers, Filemonk or another approved digital-delivery provider, Google, ClickUp, email and cloud providers, automation or AI service providers where used for a defined purpose, accountants, tax practitioners, legal advisers, contractors acting under suitable confidentiality arrangements, and regulators or authorities where disclosure is required or permitted by law.

8.4 Planned trans-border flows

TKB uses cloud and software providers that may process or store information outside South Africa. Depending on the provider, processing may occur in the United States, European Economic Area or other jurisdictions in which the provider operates. TKB will take reasonable steps to ensure that cross-border transfers are permitted under section 72 of POPIA.

8.5 General information-security measures

TKB applies reasonable technical and organisational safeguards appropriate to its size and activities. These may include role-based access, strong passwords and multi-factor authentication where supported, encryption in transit, use of reputable cloud and payment platforms, software/device security, backups, data minimisation, secure credential practices and incident-response procedures.

9. How to make a PAIA request to TKB

For a private-body request, the requester must identify the right they seek to exercise or protect and explain why the requested record is required for the exercise or protection of that right.

  1. Obtain and complete Form 2 (Request for Access to Record) from the Information Regulator's PAIA Forms page.
  2. Describe the requested record with enough detail for TKB to identify it.
  3. Identify the right to be exercised or protected and explain why access is required for that right.
  4. Provide sufficient proof of identity and, if acting for another person or entity, proof of authority.
  5. Send the request to Jody February at thekreativblock@gmail.com or deliver it to the registered office stated above.
  6. Pay any prescribed request or access fee where lawfully applicable after receiving the relevant notice.
  7. TKB will respond as soon as reasonably possible and generally within 30 days after receiving a valid request. PAIA permits a single extension of up to 30 additional days in specified circumstances, with notice to the requester.
  8. If a private-body request is refused or no response is received within the applicable period, the requester may lodge a complaint with the Information Regulator using Form 5 or pursue another remedy available under PAIA.

10. Fees applicable to private-body requests

As at the revision date of this Manual, the Information Regulator's March 2026 fee structure lists the following commonly relevant private-body fees:

  • Request fee: R140.00.
  • Photocopy / printed A4 page: R2.00 per page or part thereof.
  • Search and preparation: R145.00 for each hour or part of an hour after the first hour, capped at R435.00.
  • Deposit where a search exceeds six hours: one-third of the applicable prescribed amount.
  • Postage, email or other electronic transfer: actual expense, if any.

11. Availability of this Manual

A current copy of this Manual is available on TKB's website, at TKB's principal place of business for public inspection during normal business hours subject to reasonable operational arrangements, by email from the Information Officer upon request, as a printed copy on request subject to lawful copying fees, and to the Information Regulator upon request.

The Information Regulator's PAIA Guide states that a private body is not required to compile its PAIA Manual in more than one language or in a specific language, although it recommends that private-body manuals be available at least in English. This version is issued in English.

12. Updating of this Manual

The Information Officer will review this Manual regularly and update it when there are material changes to TKB's contact details, records, processing activities, service providers, legal obligations or request procedures. TKB intends to review the Manual at least annually.
