Terms of service

These Terms govern purchases from and use of The Kreativ Block website, Block Essentials physical products, digital products and services.

By placing an order, the customer agrees to these Terms together with the Privacy Policy, Returns, Refunds & Cancellations policy, Shipping & Delivery policy, applicable product information and any product-specific scope displayed before purchase.

Nothing in these Terms excludes or limits a consumer right that cannot lawfully be excluded under South African law.

1. About The Kreativ Block

The Kreativ Block (Pty) Ltd supplies Block Essentials physical products and provides digital products and productised services relating to business strategy, digital growth, ecommerce, marketing systems, automation, artificial intelligence and related business systems.

2. Products and services

TKB takes reasonable steps to describe its products, services, deliverables, prices and material limitations accurately. A purchase includes only the product or deliverables expressly stated on the applicable product page, service description, order confirmation, written scope or onboarding documentation.

Services or work outside an agreed scope may require a separate quotation or additional purchase.

3. No guarantee of commercial results

TKB does not guarantee a particular level of revenue, profit, sales, leads, website traffic, search-engine ranking, advertising performance, conversion rate, platform approval or other commercial result. Forecasts, scans, audits and strategic assessments support decision-making and are not guarantees of future performance.

4. Free scanners and assessments

The Growth Snapshot reviews observable signals on publicly accessible webpages. It is not a penetration test, security audit, legal audit, financial audit, accessibility certification or guarantee of business performance. The Business Readiness Audit is primarily based on information supplied by the user and is not independent verification of the business.

5. Customer responsibilities

The customer must provide materially accurate information, have authority to provide any access or material supplied to TKB, provide decisions and approvals reasonably required for delivery, and maintain suitable internal controls and backups for business-critical systems.

Customers should not send passwords, banking credentials or other highly sensitive credentials using ordinary website forms or unsecured email unless specifically instructed to use an approved secure method.

6. Service commencement, order processing and delivery

Service work begins according to the applicable product description, onboarding process or agreed project schedule. Where a customer expressly requests or agrees that a service should commence before the expiry of an otherwise applicable statutory cooling-off period, the customer requests early performance subject to applicable law.

Block Essentials processing and delivery information is set out in the Shipping & Delivery policy and on relevant product pages. Digital delivery information is set out on the relevant product page and in the Shipping & Delivery policy.

7. Payment, cancellations and returns

Prices and payment terms are those displayed on the applicable product page, at checkout or in an agreed written scope.

Unless a product expressly states otherwise, current standard TKB services are sold as once-off purchases. Paid Growth is an ongoing management service, with the ongoing payment arrangement confirmed during onboarding.

TKB does not use a general 50/50 deposit model for its current standard service products.

Physical-product returns, digital-product refunds and service cancellations are governed by the Returns, Refunds & Cancellations policy and applicable South African law.

8. Third-party services

TKB may configure, use or integrate third-party systems including Shopify, Google, ClickUp, payment providers, automation platforms, artificial-intelligence services, digital-delivery providers and other software. Third-party products remain subject to their own availability, pricing, technical limitations, policies and terms.

9. Artificial intelligence and automation

Artificial-intelligence and automated outputs can contain errors. Material automated outputs should be subject to suitable human review. The customer remains responsible for appropriate oversight of automated processes that materially affect customers, employees, finances, legal rights or business-critical operations.

10. Intellectual property

Unless expressly agreed otherwise in writing, TKB retains ownership of its pre-existing intellectual property, methodologies, frameworks, templates, systems, documentation, branding and reusable business processes.

TKB ebooks, manuals, templates and other digital products are licensed to the purchaser for personal or internal business use unless another licence is expressly stated. They may not be resold, redistributed, sublicensed, publicly uploaded or represented as the purchaser's own intellectual property without written permission.

11. Confidentiality

TKB will take reasonable steps to protect confidential business information supplied in connection with a project, except where the information is already public, independently developed, lawfully obtained elsewhere or disclosure is required by law.

12. Cancellations and refunds

Cancellations, returns and refunds are governed by the Returns, Refunds & Cancellations policy and applicable South African law.

13. Limitation of liability

To the maximum extent permitted by applicable law, TKB will not be liable for indirect, incidental or consequential loss that was not reasonably foreseeable and was not caused by conduct for which liability cannot lawfully be excluded. Nothing in this clause excludes or limits liability where South African law does not permit that liability to be excluded or limited.

14. Governing law and disputes

These Terms and transactions concluded through this website are governed by the laws of the Republic of South Africa. Nothing in these Terms prevents a consumer or data subject from exercising a statutory right to approach a competent court, tribunal, regulator, ombud, the National Consumer Commission, National Consumer Tribunal or Information Regulator where applicable.
